Ports of Auckland charged with reckless conduct

Maritime New Zealand files charges against key port-management company in connection with death of port worker in 2020.

Ports of Auckland has been charged with reckless conduct in respect of a health and safety duty by Maritime New Zealand. The suit was brought at the Auckland District Court under the Health and Safety at Work Act (HSWA) earlier today.

The case involves the 2020 death of Pala’amo Kalati, who was killed after being crushed by a falling container. If convicted, the company could face a $3m fine.

An unnamed individual is also facing multiple charges under the HSWA. No court dates have yet been set.

The case follows an independent health and safety review, commissioned by the City of Auckland, which found systematic failings in the Ports of Auckland’s health and safety practices.
